TERMS AND CONDITIONS

GENERAL PROVISIONS

  1. LAGOM online store operating at www.lagomwarsaw.com (hereinafter: Store) is a platform operated by:  LAGOM Angelika Staniszewska, Witosa 50A Street, 08-300 Sokołów Podlaski NIP 8231671922, shipment of goods and accepting returns and complaints are carried out at LAGOM Angelika Staniszewska,  Dominikańska 21B, 02-738 Warszawa. 
  2. These Regulations define the rules for the use of the Store, the conditions for placing orders for products available in the Store, the time and rules for processing orders, the conditions and forms of payment, the Customer's rights to cancel orders and withdraw from the contract, and the rules for filing and processing complaints.
  3. The Store conducts retail sales through the website using means of remote communication. In order to use the Store it is necessary: LAGOM online store operating at www.lagomwarsaw.com (hereinafter: Store) is a platform operated by:having access to the Internet; installation of the latest version of the Internet browser; acceptance of cookies.
  4. The Customer is entitled and obliged to use the Store in accordance with its purpose.
  5. The Customer is obliged to refrain from any activity that could affect the proper functioning of the Store, including, in particular, from any interference with the content of the Store or its technical elements, including the provision of unlawful content. It is forbidden to use the Store for purposes other than its intended use, including, in particular, sending spam, conducting any commercial, advertising, promotional activities, etc. on the Store's website.
  6. To the extent permitted by law, the Store is not responsible for disruptions, including interruptions, in functioning caused by force majeure, unauthorized actions of third parties or incompatibility of the Store with the technical infrastructure of the Customer.
  7. Browsing the assortment of the Store does not require registration. Independent placing of orders by the Customer for products in the Store's assortment does not require registration.
  8. The entities providing online payment service are PayPro S.A and Klarna. Possible current payment methods are specified at https://www.przelewy24.pl/ and https://www.klarna.com/pl/.
  9. The Buyer, at the latest at the time of placing an order, is obliged to familiarize himself with the Regulations.

TERMS AND CONDITIONS AND ORDER PROCESSING TIME

  1. Placing an order in the Store means that the Customer enters into a contract of purchase - sale of the ordered products with the Store.
  2. The Customer places an order, indicating the products in which he/she is interested, by selecting the "To Cart" command located on the Product Page, and then indicating in the Cart the method of receipt and payment and confirming the order.
  3. In the Cart, the Customer indicates: the ordered products and their quantity; the address to which the object of the order is to be delivered and the data necessary for issuing an invoice; the method of delivery (DHL courier, DPD courier, InPost Paczkomat); method of payment (details are included in section IV of these Terms and Conditions); (optional) discount code.
  4. In case of providing false data, the Store has the right to withdraw from processing the order notifying the Customer.
  5. Shipment of the purchased goods is carried out within 3 working days, with the deadline calculated from the date of placing the order or from the moment of confirming the payment on the Store's account.
  6. Electronic orders can be placed 24 hours a day throughout the year. Orders placed on Saturdays, Sundays and holidays will be processed from the morning of the next working day.
  7. It is possible to temporarily suspend the operation of the Store for maintenance, development and modernization works.
  8. If it is not possible to fulfill part of the order, the Store may offer the Customer:
    1. cancellation of the entire order (if this option is selected by the Customer, the Store will be released from the obligation to fulfill the order);
    2. cancellation of the order in part, in which fulfillment is not possible within the prescribed period (if this option is selected by the Customer, the order will be fulfilled in part, while the Store will be released from the obligation to fulfill it to the remaining extent);
    3. realization of substitute performance, which will be confirmed with the Customer. The order on the basis of the substitute provision, once approved by the Customer, will be treated as final;
  9. In the event that the Customer provides erroneous or inaccurate data, including, in particular, an erroneous or inaccurate address, the Store shall not be liable for non-delivery or delay in delivery of the object of the order to the fullest extent permitted by law.

PRODUCT PRICES

  1. All prices of products available in the Store are expressed in ZŁ and include VAT rate.
  2. The price listed next to the product does not include shipping costs.
  3. The store reserves the right to change prices of goods in the store, introduce new goods for sale, carry out and cancel promotional campaigns, or make changes to them in accordance with the provisions of the Civil Code and other laws, but such changes do not affect the rights of persons who have entered into contracts of sale of goods offered by the store before the aforementioned changes were made, or the rights of persons entitled to take advantage of a given promotion, in accordance with its rules and during its duration.

SHIPPING COST

  1. Shipping costs are added to the sum of the ordered products and are borne by the Customer.
  2. When receiving the shipment delivered by the courier, the Customer should check in his presence the condition of the external packaging of the shipment. In case of damage to the package of the consignment, the Customer should draw up, together with the courier, a damage protocol, in two identical copies signed by the Recipient and the courier.

PAYMENTS

  1. Payment for the goods to be delivered can be made online via Przelewy24 and Klarna.
  2. Failure to pay for the order within seven days from the date of placing the order is considered a withdrawal from the sales contract by the customer.

RETURN OF GOODS

  1. The customer, in accordance with the Act of May 30, 2014 on consumer rights, may withdraw from the contract of sale online without giving any reason within 14 days from the date of release of the product (the date of receipt of the shipment). To meet this deadline it is sufficient to send a statement before its expiration (Template) . The statement should be sent to the address of the Store's warehouse (point I General Provisions) or a scan of the signed statement to the Store's email address. If the Customer exercises the above-mentioned right, the return of mutual benefits should be made immediately, no later than within 14 days.
  2. The right of return is available only to Customers who are natural persons. The right of return does not apply to legal entities and persons engaged in business activity, if the product was purchased for the purposes of the company (legal entity, business activity).
  3. In the case described in paragraph 6. of this paragraph, the Customer is obliged to return the product in an undamaged condition in accordance with the provisions of paragraph 6. of this paragraph within the period prescribed by the applicable law. The store, upon receipt of the goods, will return to the Customer within 14 days the price paid by the Customer for the product.
  4. The Customer shall bear the direct costs associated with the return of the product.
  5. The store will refund the payment using the same method of payment used by the Customer.

COMPLAINTS

  1. The Store undertakes to provide the Customer with a product free from defects.
  2. The Customer has the right to lodge a complaint within 1 year from the date of delivery of the product, provided that he notifies the Store within 2 months from the moment of discovering the non-conformity of the goods with the contract. To meet the deadline it is sufficient to send the notice before its expiration.
  3. Complaints (Template) together with proof of purchase of this product from the Store should be reported to the e-mail address: kontakt@lagomwarsaw.com, or in traditional form to the address of the Store (point I of these Regulations).
  4. The time limit for processing the complaint is 14 days. If the Store does not respond to the complaint within this period, it is considered that the Store recognized the complaint as justified.
  5. If the complaint is resolved in favor of the Customer - the Store will repair or replace the Customer's advertised product with a full-quality one, or, if replacement is not possible, refund the amount due for the advertised product within 14 days from the date of receipt of the defective product from the Customer.
  6. The Customer, in the situation described in paragraph 5 of this paragraph, is obliged to return the object of the order in whole or in part to the address of the Store.
  7. The Store will refund the payment using the same method of payment used by the Customer.

PERSONAL DATA SECURITY AND PRIVACY POLICY

  1. The administrator of the databases of personal data submitted by the store's customers is the Store.
  2. The store undertakes to protect personal data in accordance with the Personal Data Protection Act of August 29, 1997 and the Electronic Services Act of July 18, 2002. The customer, by providing his/her personal data to the Store when placing an order, agrees to their processing by the Store for the purpose of processing the order placed. The customer has the opportunity to review, correct, update and delete his/her personal data at any time.
  3. Detailed rules of collecting, processing and storing personal data used for order processing by the Store are described in the Privacy Policy, which can be found at: www.lagomwarsaw.com/privacypolicy.

FINAL PROVISIONS

  1. Differences between the visualization of the product resulting from individual settings of the Customer's computer (color, proportions, etc.) and the actual appearance of the product cannot be the basis for a complaint. The Customer, in such a case, has the right to withdraw from the contract in accordance with the provisions of paragraph V of these Regulations.
  2. The Seller informs that all trademarks (logos, logotypes, brand names, etc.), graphic materials, photographs placed on the Store's website are subject to legal protection under copyright laws.
  3. Matters not covered by these Regulations shall be governed by applicable provisions of Polish law, including in particular the Civil Code, the Act on special conditions of consumer sales and amendments to the Civil Code, as well as the Act on the protection of certain consumer rights and liability for damage caused by dangerous products.
  4. These Regulations are effective as of 14.10.2022.
